NGB Extra: Masterclass Current Affairs in Procurement Law

On November 24, mr. Drs. Martijn Jongmans, lawyer within the Competition & Procurement, the masterclass in procurement law.

On January 15, 2014, three new procurement directives were adopted in Brussels. That means new rules for:

  • classic procurement (2012/24/EU);
  • for special sector companies (2014/25/EU) and;
  • for concessions (2014/23/EU).

For Dutch procurement practice, this means that the Public Procurement Act 2012, the ink of which is barely dry, must be overhauled again. The amended Public Procurement Act came into effect on July 1, 2016.

What exactly these new rules mean in practice and how you can make use of them is the subject of the first part of the meeting. Consideration will be given, among other things, to the new rules, which are very important in practice, for changing contracts after award. Which changes are permitted without the amended contract having to be retendered?

The second part considers the question to what extent public procurement rules play a role in private purchasing processes. 
What can you do as a purchasing party to sideline procurement law principles? 
What options do the public procurement rules offer when your company participates in a private tender?
