Divorce:

Private international law

Inheritance law
  • What is your position in an estate? And what rights and obligations are involved?
  • You are appointed heir. Which choice (pure acceptance, beneficiary acceptance or rejection) is appropriate? And what rights and obligations go with it?
  • There is a will and you have been disinherited as a (grand)child. What rights do you nevertheless have?
  • You cannot agree with the other heirs on the distribution of the estate;
  • You are executor, will administrator or liquidator and you need legal assistance in carrying out your task. And conversely: an executor, testamentary administrator or liquidator has been appointed and you are dissatisfied with the performance of your duties;
  • You have a claim against the deceased that has not yet been settled. What are your options to still collect your claim?
Estate planning
  • It is important to think about the (most fiscally favorable) design of your estate and who, what, in what way and under what conditions should receive from you and who should not;
  • If you are married or registered as a partner, it is also important to consider whether the marital regime deserves adjustment (making or changing the prenuptial agreement/partnership agreement);
  • If you are living together informally, it is important to consider whether it does not make sense to enter into a cohabitation agreement or get advice on whether the cohabitation agreement needs adjustment;
  • You are thinking about making a power of attorney or living will in case at any time you are no longer (adequately) able to look after your own financial and other interests.
