Financing & Collateral

Financing & securities are inextricably linked to corporate law. This is partly because the market is constantly changing and financing forms and securities must adapt accordingly. Examples include private equity, syndicated loans, securitization, factoring, netting, project and group financing and, last but not least, crowdfunding. Moreover, financing and collateral often have cross-border aspects. In addition, technical aspects and the creation of financing via the Internet as well as the ever-expanding regulations in these areas play an increasingly important role.

Inherent in financing is the need for collateral. Classic securities are pledge and mortgage rights, but also supplier credit, surety, (bank) guarantees and the joint and several liability of debtors. Our lawyers advise on the establishment and enforcement of securities, whether or not in (the prospect of) bankruptcy. Knowledge of insolvency law is therefore required.
